Carlson, Scott Allen, “The Gerrymandering of the Reconstruction Amendments and Strict Scrutiny: The Supreme Court’s Unwarranted Intrusion into the Political Thicket,” Thurgood Marshall Law Review, 23 (Fall, 1997), 71ff.

Abstract:

Misappropriating the Constitution’s original intentions, the American Judicial system has incorrectly internalized the original intent of the Fourteenth Amendment. The Court has applied unnecessary scrutiny to white voters and inadvertently produced a constitutional violation. It is imperative that the Court recognize that our country has a long way towards ending such discrimination.
